CBD gets EU Novel Food authorization stamp

The path to a fully regulated CBD market in Europe just reached a major milestone. Following years of rigorous scientific debate, the European Food Safety Authority (EFSA) has finally published a provisional safe intake level for CBD as a "Novel Food."
At CBD Seed Europe, we see this as a pivotal moment. While the specific numbers are subject to intense discussion, one fact is now undeniable: a safe intake level for CBD exists. This provides the industry with the scientific "anchor" it has needed to move forward with full authorization.
The Numbers: A Conservative Starting Point
EFSA has set a provisional safe level of approximately 0.0275 mg/kg of body weight per day. For an average 70 kg adult, this translates to roughly 2 mg per day.
While we welcome the clarity, it is important to note that this level is exceptionally conservative.
For comparison:
- United Kingdom (FSA): Recommends a limit of 10 mg/day.
- EIHA Research: Proprietary toxicological studies submitted by the EIHA support a safe level of 17.5 mg/day.
The discrepancy between these figures highlights that while the EU is taking a cautious approach, the global scientific consensus is moving toward much higher acceptable daily intakes.
Bridging the Data Gap
The European Industrial Hemp Association (EIHA), which we proudly support, is already working to bridge the gap between EFSA's conservative 2 mg limit and the scientifically supported 17.5 mg limit.
Achieving this requires filling specific "data gaps" through high-quality, proprietary toxicological studies. This is an ongoing process, and we are optimistic that as more data is submitted, the permitted levels will align more closely with the realities of consumer use.
What Happens Next?
The establishment of this provisional level—however conservative—is a green light for the Novel Food authorization process to proceed for CBD isolates in the EU.
Key takeaways for the industry:
- Authorization is within reach: We expect applications to progress based on the 2 mg/day level in the immediate term.
- Timeline for 2026: The EIHA and its partners are finalizing the last pieces of data requested by EFSA, with the goal of achieving final authorization before the end of this year.
- Consistency is coming: This move marks the beginning of the end for the "grey market," replacing it with a regulatory environment grounded in sound science.
Our Commitment to Quality
At CBD Seed Europe, our focus remains on providing the genetics that produce the highest quality, compliant raw materials. We advocate for a market that protects public health while ensuring European consumers have access to safe, effective CBD products.
